Article 11 explained in plain English
This article regulates the Criminal Investigation and Prosecution Unit (the Unit). Its provisions are in six paragraphs:
- Link and jurisdiction: The Unit is linked to the President, and is competent for criminal investigation in corruption crimes and bringing and conducting criminal cases before the competent court.
- Composition: It consists of a number of circuits, and the head of each circuit and its members are named by decision of the President.
- Conditions: A member of the Unit must meet the legal conditions required to hold the post of a member of the Public Prosecution.
- Appointment and transfer: Filling the post of a member of the Unit and transferring him to any other body is by royal order based on a decision of the Unit's council.
- End of service: Other than in cases of death, reaching the legal age and failure to prove fitness during the probation period, a member's service ends by royal order based on a decision of the Unit's council.
- Leadership: The Unit has a head and a deputy whom the President names from among the appointed members of the Unit.
These provisions show that members of the Unit are treated in their conditions in a way close to members of the Public Prosecution, and that their appointment and transfer, and the end of their service other than in the exempted cases in paragraph 5, are by royal order, which gives them job protection. The article does not specify those conditions, so refer to the legal provisions on a member of the Public Prosecution.
The article connects to Article 10, which counts the Unit among the Authority's main units, and to Article 12, which gives the work of its members judicial status and complete independence. Anyone subject to a criminal investigation by the Unit would do well to engage a lawyer specializing in criminal cases.
