Article 82 explained in plain English
This Article sets out the cases in which the Higher Officers Committee may recommend ending an officer's study mission, which are:
- If a judgment imposing a Sharia hadd penalty or a crime involving moral turpitude or breach of trust is issued against him.
- If he causes, intentionally, through negligence or unintentionally, harm to the reputation of the Kingdom or the Armed Forces.
- If the institute where he studies takes a decision to dismiss him for any reason.
- If he is absent from study, engages in political activity, or joins a party.
- If the results indicate his shortfall or probable failure, and this results from negligence on his part and not from compelling or health reasons.
- Any other reasons for which the Committee considers ending his mission, out of concern for the interest of the Armed Forces.
Note that in the second case, harm to reputation is a ground even if it occurs unintentionally. The fifth case is restricted to a shortfall resulting from negligence; if it is due to compelling or health reasons, it does not fall within it.
The sixth case is broad, as it gives the Committee discretion to recommend ending the mission for any reason it considers serves the interest of the Armed Forces. Note also that the Committee's role is to recommend; the Article uses the words "may recommend", so this is a power and not an obligation.
An officer facing the possibility of his mission being ended may consider consulting a lawyer specializing in administrative cases and military service matters.
Practical example
The results of Captain Abdullah, studying abroad, were delayed because of a documented illness that put him in hospital for several weeks. This does not fall within the fifth case because the shortfall resulted from a health reason, not negligence. Had the delay been due to his absence and negligence, the Committee could have recommended ending his mission.
