Article 149 explained in plain English
This article establishes the rule of impartiality in the officers' subcommittees.
If the subject of discussion affects one of the committee's members, that member must not attend the committee meeting held to consider his matter.
The main features of the provision:
- It is mandatory, in the form "must".
- It is limited to the meeting held to consider his matter.
- The text does not define what "affects" the member, and does not set procedures for verifying this.
The apparent purpose of the rule is to protect the integrity of the recommendation, so that someone connected with the matter does not take part in considering it.
If the subject affects the committee chairman himself, Article 148 provides that when he is absent the most senior member among the committee's officers replaces him.
This article is connected to Article 150, which gives the Chief of the General Staff the right to object to the officers' subcommittees' recommendations, to return them to them to be considered afresh, or to issue his decision on them directly within his powers under the provisions of the Law.
