Article 3 explained in plain English
While Article 2 sets the maximum limits of the penalties, Article 3 explains how the penalties for each specific violation are determined, through a schedule issued by decision of the Minister:
- Content of the schedule: the violations and their corresponding penalties from among those provided for in Article 2, under a clear governance mechanism, taking into account gradation in the amount of the penalty and its proportionality to the type of violation, its repetition, and its impact.
- Doubling: the schedule specifies the violations for which the fine and the closure (paragraphs 1 and 2 of Article 2) may be doubled on repetition, by increasing their maximum limits, provided the increase does not exceed double.
- Obligation to remove: the schedule includes the violations for which the violator is required, within a specified period and at his own expense, to remove the violation, restore the situation to what it was, or repair the damage resulting from it, if any. If the period ends without his doing so, a new violation is recorded against him.
The meaning of the third paragraph is that paying the fine is not enough for some violations; the situation must be corrected, otherwise violations accumulate. The Article does not list the violations themselves or their amounts; these are in the schedule issued by the Minister.
It is followed by Article 4, which provides for detecting violations and recording them in reports. Anyone who believes the penalty applied to him is not consistent with the schedule may consult a specialized lawyer in administrative matters (the Board of Grievances).
Practical example
A shop owner in Riyadh violated the signage requirements, so he was fined and required to remove the violation within a specified period. He did not remove it before the period ended, so a new violation was recorded against him under this Article.
