Article 13 explained in plain English
This article regulates the route for objecting to municipal license decisions and fines.
Paragraph (1) - the committees and their jurisdiction: committees are formed by decision of the Minister in the amanahs and municipalities, as the case may be, to consider:
- Grievances over refusal to grant the municipal license, or its suspension, non-renewal, amendment or cancellation.
- Grievances over the application of municipal fines and penalties prescribed by law.
- Complaints arising from harm caused by the use of municipal licenses.
Paragraph (2) - organizing the committees: the Implementing Regulations set the number of members of each committee, their qualifications, the term of membership, alternate members, how decisions are issued, the periods required to decide these grievances and complaints, the committees' working procedures and their members' remuneration. The article does not set a deadline for submitting a grievance to the committee or a time limit for deciding it; it leaves this to the Implementing Regulations.
Paragraph (3) - appeal to the courts: a grievance against the decisions of these committees may be brought before the Administrative Court within 60 days from the date of becoming aware of them.
It is important to note that the sixty days run from the date of becoming aware of the committee's decision. Anyone who wishes to appeal should consider consulting a lawyer specializing in administrative matters.
Practical example
The municipality suspended the municipal license of a restaurant owned by Saad in Taif. Saad can file a grievance against the suspension decision with the competent committee in the municipality, and if the committee issues a decision he is not satisfied with, he may bring a grievance against it before the Administrative Court within 60 days from the date he became aware of the decision.
