Article 2 explained in plain English
This Article is the heart of the Law, and contains two paragraphs with different penalties.
Paragraph (a): counterfeiting money and dealing in it
It covers anyone who:
- counterfeited or forged money lawfully in circulation in the Kingdom or abroad.
- brought in counterfeit or forged money in circulation, or issued it.
- engaged in dealing in it or promoting it by any means.
- made, acquired, or possessed without justification all or part of the machines, materials, means, or tools of counterfeiting, in bad faith.
The penalty: imprisonment for a period of not less than 5 years and not more than 25 years, and a fine of not less than SAR 30,000 and not more than SAR 500,000. The two penalties here are combined.
Paragraph (b): possession with knowledge
It covers anyone who possessed counterfeit or forged money of the money lawfully in circulation inside or outside the Kingdom, knowing it was counterfeit and without an acceptable reason.
The penalty: imprisonment for not more than 5 years, and a fine of not more than SAR 50,000, or one of these two penalties.
The fundamental difference is that mere possession is punished only with knowledge of the counterfeiting and the absence of an acceptable reason. The meaning of "money" relies on the definition in Article 1. This Article has been amended more than once, most recently by Royal Decree No. (M/48) dated 2/8/1426 AH.
To assess the position of a particular person or to defend in a pending case, it is advisable to consult a lawyer specializing in criminal matters.
Practical example
A person in Riyadh was caught carrying a bundle of counterfeit SAR 500 notes, knowing they were counterfeit and without an acceptable reason, so paragraph (b) applies to him. Someone found with a printing machine he uses to forge currency in bad faith is subject to paragraph (a) with its harsher penalty.
