Article 30 explained in plain English
This article protects the funds of those covered by the Law from a guardian or executor who is no longer able or fit to manage them.
Whom does it cover? The guardian, the executor, the curator, the agent and the supervisor.
When? In three cases:
- If he is absent.
- Or placed under interdiction.
- Or defaulted in managing the funds of those covered by the Law.
The Authority's duty: it must ask the competent court for:
- His removal.
- And the appointment of the Authority or another as custodian to manage the funds, as the circumstances require.
After the judgment:
- The person appointed under the judgment must take over the funds in the removed person's hands, and record this in detail.
- The removed defaulting person must submit a detailed account for the period of his management within three months of the date the judgment is issued.
- If he refuses to submit the account, the matter is referred to the court.
Removal is by judgment of the court, not by decision of the Authority. After it comes Article 31, which requires the Authority to ask for the appointment of a litigation executor if the covered person's interest conflicts with the interest of the Authority or of his guardian or executor.
If you notice a default by an executor over orphans' funds in your family, you can notify the Authority or consult a lawyer who specializes in personal status and estates.
Practical example
The court appointed Salem executor over the funds of his late brother's minor sons in Buraydah, and it then became clear that he had neglected to collect the rent on their property for years. The Authority must ask the court to remove him and appoint a custodian. After the judgment, the custodian takes the funds over from Salem with a detailed record, and Salem must submit a detailed account for the period of his management within three months.
