Article 24 explained in plain English
This article regulates the first practical step after the Authority learns of a minor or someone treated like a minor who has funds: inventorying the funds.
When does the Authority begin? On receipt of the inventory of heirs or the notifications provided for in the preceding articles.
What does it do?
- It takes the necessary steps to preserve the rights of those covered by the Law.
- It inventories their fixed and movable funds, and everything they are owed and they owe.
The power to check: to that end the Authority may check what is contained in their residences and the places in their possession, and any other places where it considers it likely that they have funds.
The safeguard of attendance: this is done only in the presence of one of the following:
- One or more of the adult heirs, after all the adult heirs have been notified of it.
- Or a representative of the competent court.
- Or a member of the Investigation and Public Prosecution Authority.
After the inventory: the Authority takes over the funds and facilities and manages them in accordance with the provisions of this Law.
It is assisted in this by Article 23, which requires governmental and non-governmental bodies to supply it with the data it requests. And Article 25 bars the heirs and partners from dealing with the estate from the date of death until the inventory is complete.
If you are one of the adult heirs, you have the right to be notified of the date of the check. Anyone with a question about the inventory procedures can consult a lawyer who specializes in personal status and estates.
Practical example
The Authority received a deed of heirs for a man who died in Al-Ahsa leaving a wife and four sons, three of them minors. The Authority notified the adult son and the wife of the date it would come to the house, and in the son's presence inventoried the funds and belongings there, then inventoried what the deceased was owed and what he owed.
