Article 13 explained in plain English
This article regulates keeping a military member in service after reaching retirement age, and distinguishes three categories:
First: the officer (paragraph a)
- He may be kept on for two years if his continued service is necessary in the interest of the work.
- This is done by decision of the Minister on the recommendation of the Chief of the General Staff.
- The period may be extended year by year, provided it does not exceed four years.
Second: the medical officer (paragraph a)
- By decision of the competent Minister, when the interest of the work requires it, his service may be extended for a maximum of ten years.
- The extension is made in periods, each of which may not exceed five years.
- In all cases he is retired once he reaches 65.
Third: the technical person (paragraph b)
- He may be kept on for five years, extendable for another five years, if his continued service is necessary in the interest of the work.
- This is done by decision of the Chief of the General Staff after the recommendation of the head of the Army Administration Authority or the commander of the Air Force or Navy.
Effect of the extended period: in all three categories the period counts toward the retirement pension and retirement contributions are deducted for it.
This article follows Article 12, which allows the provisions of Article 11 to be suspended for a given period or periods by order of the Supreme Commander of the Armed Forces at the Minister's request. The difference is that Article 12 concerns a general suspension, whereas this article concerns keeping particular individuals on because the work requires it. The provision on the medical officer was added to the end of paragraph (a) by Royal Decree No. (M/35) dated 26/9/1423 AH.
Practical example
Dr. Ahmed, a medical officer, reaches the statutory retirement age, and the interest of the work requires him to stay. Under this article, the competent Minister may decide to extend his service in periods of no more than five years each, up to a maximum of ten years, provided he is retired once he reaches 65. The extension period counts toward his retirement and contributions are deducted for it.
