Article 15 explained in plain English
This Article deals with the relationship between psychiatry and criminal justice.
First: the bodies and committees. The Minister of Health designates government facilities that assess the mental condition of a person suspected of having a mental illness or intellectual disability, at the request of the judicial or investigation authorities. In them he forms forensic psychiatric medical committees of at least three psychiatry consultants, Saudis where possible, with alternate members; they are re-formed every 3 years, their reports are approved by the facility, and the Implementing Regulations explain their working procedures.
Second: assessment procedures for a person accused of a crime:
- The report: approved by the committee, setting out his mental condition at the time of the crime and at the time of assessment, the extent of his criminal responsibility, and the proposed treatment plan.
- Staying: the accused must remain in the facility to complete the assessment, and he may not leave even on bail, except by order of the authority that requested the assessment.
- Admission: within a period of no more than 7 days of the date of the request.
- Length of assessment: not more than 30 days, renewable at the committee's request and with the approval of whoever requested the assessment (the judge or the competent member of the Investigation and Public Prosecution), and it may be extended by not more than 90 days, then another 90 days with the local council informed. In all cases an extension is allowed only with the approval of the requesting authority.
Third: special departments are set aside for treating convicted and accused mental patients; the medical service in them is the facility's responsibility and security protection is the responsibility of the security authorities. The Implementing Regulations regulate coordination among the bodies under this Law and the Law of Criminal Procedure.
The Article does not say what effect the result of the assessment has on the judgment; that is for the judicial authority.
If you have a specific case, it is best to consult a lawyer who specializes in criminal cases and health regulations.
Practical example
A young man in Riyadh was accused of assaulting his neighbor, and his family said that he suffers from a mental disorder. The judge requested an assessment of his condition, so he was admitted within 7 days to the designated government facility, and he may not leave even on bail except by order of the judge. The committee prepares a report on his condition at the time of the crime and at the time of assessment and the extent of his criminal responsibility.
