Article 13 explained in plain English
This article regulates how inspection visits are planned during official working hours. In each office the head of labor inspection organizes them through weekly programs prepared in advance, approved by the office director, on the following basis:
(a) Assigning establishments to inspectors: this takes into account the number of establishments within the office's area and their nature and size, the number of their workers and their categories, the variety of provisions that must be monitored, and the physical means available to the inspectors. The assignment is by administrative orders approved by the office director and communicated to the inspectors; they may be changed as work requires, with a copy sent to the Ministry's Deputy Ministry for Labor Affairs.
(b) The weekly program sets out: the inspector's name, the establishments he inspects each day, and the date, time and type of the visit. It distinguishes between general inspection visits, which examine working conditions from all angles, and special visits such as re-inspection and examining complaints, accidents and occupational diseases.
(c) Timing of the visit: it should take place while the establishment is carrying on its activity in full, taking into account how its working hours are distributed. The inspector must set aside part of his working time for administrative and clerical work without this affecting inspection time.
This program is internal to the office and does not mean notifying the establishment in advance, since Article 11 bars advance notice of the visit. Inspection outside working hours is regulated by Article 14. Anyone with a question may consult a lawyer specializing in labor cases.
