Article 3 explained in plain English
Some claims have no determinable monetary value, so the percentages in Article 2 do not suit them. For these, this Article sets flat amounts according to the type of claim:
- Private criminal claims: SAR 10,000.
- Claims before commercial courts and circuits: SAR 5,000.
- Urgent claims, whichever court or circuit hears them: SAR 3,000.
- Claims before general courts: SAR 3,000.
- Enforcement disputes: SAR 3,000.
- Claims before labor courts and circuits: SAR 2,000.
Note that an urgent claim carries a single amount (SAR 3,000) whichever court hears it, even a commercial court. These amounts apply only to claims of undetermined value.
If a claim combines one claim of determined value with another of undetermined value, the costs of each are calculated separately under Article 4. This Article does not say who ultimately bears the costs or when exemption from them applies. Anyone who needs to know how their claim is classified and what it will cost should consider consulting a lawyer specializing in litigation and procedure.
Practical example
A worker files a claim before the labor court asking that the employer be ordered to give him an experience certificate, which is a claim of undetermined value. The judicial costs of this claim are assessed at a flat amount of SAR 2,000.
