Article 6 explained in plain English
This article regulates the procedures for submitting the allowance application in four paragraphs:
1. The means of submission: the application is submitted to the Human Resources Development Fund or its delegate through the electronic platform or any other means the Fund specifies.
2. The application period: the application is submitted subject to one of two periods:
- Before 24 months have passed from the date study or training ended at any stage.
- After 24 months have passed from the date the employment or work relationship ended, for someone who previously worked in the public or private sector, subject to paragraph (7) of Article 5, which is the condition that the person is not paid an allowance or compensation against unemployment.
The Council may amend these two periods in agreement with the National Development Fund.
3. The applicant's obligations: to attend at the time the Fund sets to assess the application, to provide all the documents it requests in the way it specifies, and to comply with the instructions it issues while the application is being studied, as the implementing rules determine.
4. The decision: the Fund studies the application to verify the eligibility conditions and notifies the applicant of the decision within a period not exceeding two months from the date the application is completed, not from the date it is submitted. If the decision is a refusal, it must give reasons, so the applicant knows why it was refused.
To confirm the period that applies to a particular case, it is advisable to refer to the Fund or consult a lawyer who specializes in administrative cases.
Practical example
Lina graduated from university, so she must submit her application through the electronic platform before 24 months have passed from the date her study ended. After she completes her application documents, the Fund must notify her of its decision within a period not exceeding two months, and if it refuses the application it must state the reason.
