Article 1 explained in plain English
This is the definitions article, and it is the key to understanding the rest of the Regulation, because each term defined in it carries the meaning set here wherever it appears, unless the context requires otherwise. The main ones are:
- The Fund: the Human Resources Development Fund, and the Council: its board of directors.
- The applicant: anyone who applied to benefit from the allowance. The qualified person: an applicant who meets the eligibility conditions and has not yet begun to benefit. The beneficiary: a qualified person who actually receives the allowance. This gradation matters because the obligations and penalties in later articles differ according to the status.
- The family: members who live in one home, comprising a husband and wife (or more than one wife) and their children or some of them.
- The retirement pension: an amount paid monthly to the applicant as direct entitled person under the civil or military retirement law or the social insurance law.
- Monthly income: the total of what the applicant and their family obtained during the month before the application from salaries, commercial returns or otherwise, and wealth: their assets and valuable property, both as the implementing rules determine.
- Training: technical or vocational training that lasts longer than 3 months.
- On-the-job training and e-training: tasks requested by the Fund or its delegate to develop the skills of the qualified person or beneficiary and increase their chances of obtaining a job; the latter is done through the electronic platform or technology means.
- The Fund's delegate: a government or private entity the Fund delegates some of its tasks to, and the electronic platform: the website or application the Fund creates or designates.
Note that income and wealth are calculated for the applicant and their family, not for the applicant alone, and that income is measured over the month preceding the application for the allowance.
