Article 75 explained in plain English
This article complements the seizure provisions in Articles 73 and 74, and concerns funds owed to the taxpayer held by others, that is, amounts others owe the taxpayer.
- Notice to third parties: After seizure is imposed, the Department may issue notices to third parties, such as an employer, banks or financial institutions, requiring them to pay directly to the Department any amounts they owe the taxpayer on the date of receiving the notice or after it.
- Notice to the employer: The notice may be directed to the employer for whom the taxpayer works, with the validity of the notice limited to a specified period.
- What seizure does not reach: The monthly alimony the taxpayer is obliged to pay and his living expenses as required by other laws in force. Seizure does not touch these amounts.
- Relief of the complying party from liability: A person who complies with the provisions of this article and Articles 73 and 74 is relieved of liability to the taxpayer or any other person in respect of the value of the seized property from the time of his compliance. A bank or employer that pays the Department in execution of the notice is not asked for that amount again.
Article 73 states that a person who does not comply with handing over the seized asset or preventing withdrawal from the account must pay an amount equal to the value of the property in his possession, not exceeding the amount for which the seizure was made. If you receive a notice of this kind, whether as a taxpayer or a third party, it is advisable to consult a lawyer specializing in tax cases.
Practical example
After seizure was imposed on a resident taxpayer who works at a company in Riyadh, the Department sent the company a notice, valid for a specified period, asking it to pay the amounts due to him directly to it. The company complies, and is not held to account before the employee for what it paid the Department, bearing in mind that seizure does not fall on the monthly alimony he is obliged to pay and his living expenses required by the laws.
