Article 7 explained in plain English
This article sets out the tax rate applied to the tax base (determined in Article 6) according to the taxpayer's category:
- 20% for each of: a resident capital company, a resident non-Saudi natural person who carries on activity, and a non-resident on his activity in the Kingdom through a permanent establishment.
- 20% for a taxpayer working in natural gas investment.
- 85% for a taxpayer working in the production of oil and hydrocarbons.
Withholding tax: paragraph (d) refers to the rates set in Article 68, which are: 5% for rent, 15% for royalties, 20% for management fees, 5% for airline tickets and air or sea freight, 5% for international telephone communications services, and any other payments set by the Regulations at a rate not exceeding 15%.
Someone working in both fields: under paragraph (e), if a person works in the Kingdom in both oil and hydrocarbons production and natural gas investment, the tax due from him is the sum of the tax on his two bases under paragraphs (b) and (c); that is, each field's base and rate are applied and then the two results are added.
The record of amendments shows that paragraph (b) was amended to take its present text (20%) and that paragraph (e) was added to the article. The rate is applied to the base after deducting allowable expenses, not to total revenue. To assess the tax on a specific establishment, it is advisable to consult a lawyer specialized in tax and commercial matters.
Practical example
A limited liability company in Riyadh whose foreign partner's share of its taxable income, after deducting allowable expenses, is SAR 500,000. The tax is 20% of this base, that is, SAR 100,000.
