Article 145 explained in plain English
This article sets the penalties for smuggling, what is treated as such, and attempts at either, without prejudice to any more severe penalty in other laws in force.
Penalties by type of goods (a fine and imprisonment, or one of them):
- Goods with high duties: a fine of not less than twice the duties and not more than twice the value of the goods, and imprisonment of one month to one year.
- Other goods: a fine of not less than twice the duties and not more than the value of the goods, and imprisonment of one month to one year.
- Exempt goods: a fine of not less than 10% of the value of the goods and not more than their value, and imprisonment of one month to one year.
- Prohibited goods: a fine of not less than the value of the goods and not more than three times it, and imprisonment of six months to three years.
Confiscation:
- (5) Confiscation of the goods that are the subject of smuggling, or a ruling for their equivalent value if they were not seized.
- (6) Confiscation of means of transport, tools and materials used in smuggling, other than public means of transport such as ships, aircraft, trains and public cars, unless they were prepared or rented for this purpose, or a ruling for their equivalent value if they were not seized.
Repeat offending: (7) double the penalty may be imposed.
Note that an attempt is punished with the same penalties. Article 144 requires intent for criminal liability. Article 146 allows the Director General to hold and sell seized goods and means of transport when the smugglers flee. A person facing an accusation of smuggling needs a lawyer specializing in criminal and customs cases.
Practical example
A person is caught trying to bring in prohibited goods worth SAR 50,000. He may be punished with a fine of not less than SAR 50,000 and not more than SAR 150,000, and imprisonment of six months to three years, or one of them, with confiscation of the goods, even though the smuggling was not completed, because an attempt is punishable.
