Article 41 of the Saudi Fertility Units Law

This article contains two closing provisions:

First: publication and effect

• The Law is published in the Official Gazette.
• It takes effect 120 days after the date of its publication.

Second: existing units

• Who: fertilization, embryo and infertility treatment units existing when the Law was issued.
• The duty: to complete the necessary conditions and requirements and correct their status.
• The period: 120 days from the date the Law takes effect, not from the date of its publication.
• After the period: their matter is submitted to the Supervisory Committee to consider whether their license continues.

Existing units therefore do not lose their status at once, but they do not continue automatically either; they are given a period to correct their status, and then the Supervisory Committee considers whether their license continues. The article does not state what the Committee decides in each case.

This article is linked to Article 40, which obliges the Minister to issue the Implementing Regulations within 120 days of the Law's publication; the Regulations and the Law thus coincide roughly, and the period for correcting status then starts from the date the Law takes effect.

The text before us does not state the publication date, so the Official Gazette should be consulted for the actual dates. A person who has an existing unit and wants to know its position may consult a lawyer who specializes in health regulations.
