Article 9 explained in plain English
This article specifies who may carry out dangerous technical work connected with explosives and fireworks. Nobody other than authorized persons may do any of the following:
- Carry out blasting work, that is, actually performing the blasting.
- Supervise blasting work, since supervision in turn needs a permit and the prohibition is not confined to carrying it out.
- Operate fireworks equipment.
Under Article 1, an authorized person is a natural or legal person who meets the required conditions and holds a permit from the Ministry of Interior.
The importance of the article is practical: obtaining explosives or fireworks by lawful means does not mean anyone can operate them. If an organizer of an occasion buys fireworks under a permit, operating their equipment remains confined to someone authorized to do so.
The article does not state the conditions for obtaining these permits, but Article 10 refers to the Regulations the specification of the conditions and procedures for obtaining permits for blasting technicians and professionals working in explosives, as well as matters relating to holding fireworks displays, their venues and those authorized to operate them.
The article is linked to Article 8, which requires a permit from the Ministry to use security guard company guards to guard explosives. Anyone who wants to work in this field or organize a fireworks display can consult a lawyer who specializes in criminal cases.
Practical example
An events company in Jeddah wanted to hold a fireworks display at an opening ceremony. None of its employees may operate the fireworks equipment; the operation must be carried out by a person authorized for it by the Ministry of Interior.
