Article 5 explained in plain English
Article 5 gathers the obligations of anyone who uses expatriate labor, whether a company, private establishment or individual, which are:
- Residence permits and work permits: Ensuring the workers obtain residence permits and work permits, and renewing them on time.
- Not using other people's workers without following the established legal rules.
- Not letting workers work for others without following the established legal rules.
- Not letting workers work for themselves.
- Reporting absence: Notifying the competent authorities when workers are absent from the workplace within five days of the date of their absence.
These obligations are part of an integrated system: Article 4 requires the sponsor of a visitor to report the visitor's overstay and treats failure to report as concealment, and Article 6 requires government bodies to make sure that expatriates working for them or in their fields of jurisdiction have valid residence permits and are authorized to work or work under recognized official contracts. So the duty is spread across the private sector, individuals and government bodies.
Note that the text allows a worker to work for someone other than his employer, or the use of other people's workers, when the established legal rules are followed, and this article does not set out those rules. Someone who has an absent worker or who wishes to have workers work for another party may consult a specialist lawyer in residency laws and administrative cases.
Practical example
