Article 11 explained in plain English
Article 11 identifies the body that decides the violations in these rules, and contains three provisions:
- Jurisdiction: The committees formed in the General Directorate of Passports and its branches examine the violations in the rules.
- Approval: The decisions of these committees do not take effect on their own, but are approved by the Minister of Interior or his delegate.
- Transfer of jurisdiction: The Minister of Interior may by decision transfer the jurisdiction to examine these violations to committees formed for this purpose in the Ministry of Interior.
This article is linked to what comes before and after it:
- Article 10 has the Ministry of Interior apply to the violators referred to in Articles 1, 3 and 4 the penalties provided in Articles (4) and (5) of the Regulation of the Treatment of Arrivals to the Kingdom.
- Article 12 allows anyone against whom an administrative decision of these committees is issued to file a grievance with the Minister of Interior within a period not exceeding thirty working days from the date he is notified of or learns of the decision.
So the practical path for someone accused of a violation begins with the committee's examination, then approval of its decision, then the possibility of a grievance. The article does not set out the committees' working procedures or how they are formed. Anyone whose violation has been referred to one of these committees would do well to consult a specialist lawyer in residency laws and administrative cases.
