Article 10 explained in plain English
This article details the rules on ozone-depleting substances specified by the competent authority, and the devices that contain them, in four paragraphs:
- The substances themselves: Importing, exporting, re-exporting, trading in, manufacturing or using them is prohibited without a permit or license, as the regulations determine.
- New or recycled devices, equipment and products containing these substances: Importing, exporting, re-exporting, manufacturing or using them is prohibited without a permit or license, as the regulations set out.
- Disposal of the substances, devices, equipment and products mentioned in paragraphs 1 and 2 is as the regulations set out, so it is not left to the choice of their owner.
- Used devices, equipment and products containing these substances: Importing them is prohibited; the paragraph does not mention the possibility of an exception by permit or license.
The important practical difference is therefore this: dealing in new and recycled items is possible with a permit or license, while importing used items is barred by the text of paragraph 4 without linking it to a permit.
This article complements Article 9, which requires users of these substances to carry out the phase-out plans and gives the competent authority the power to specify them. Procedural details are referred to the regulations. Traders and importers in this field can consult a lawyer specialized in environmental laws.
Practical example
A device trader in Jeddah is offered a shipment of used air conditioners from abroad containing a gas that the competent authority has specified among the ozone-depleting substances. Paragraph 4 of Article 10 prohibits importing these used devices, while importing new devices containing the same substance requires a permit or license.
