Article 40 explained in plain English
This article sets the rules for the period for which the secondment allowance is calculated:
- Start: from the time the member leaves his original place of work.
- End: on his return.
- Limit: it is paid only for the days necessary to carry out the mission.
It then deals with illness during secondment, providing for the allowance to be counted for sick leave days on conditions that apply together:
- The sick leave must fall within the period for which the secondment allowance is calculated.
- The member notifies the body he is seconded to of his illness, or the nearest government department if there is no military command.
- The body that seconded him approves counting this period as secondment.
- The period counted must not exceed 15 days or half the period of the secondment, whichever is less.
In practice, if a member falls ill on his mission he does not automatically lose the allowance, but he must take the initiative to give notice, his body's approval must be obtained, and he is not credited with more than the limit stated. Anyone with a dispute about the counting of his secondment days may consult a lawyer specialized in administrative matters and military service affairs.
Practical example
Sergeant Fahd was seconded for twenty days, and fell ill on the fifth day and obtained eight days of sick leave and notified the body he was seconded to. If his body approves counting them as secondment, he is credited with a maximum of ten days because half the secondment period is ten, which is less than 15, so his eight days are counted in full.
