Article 1 explained in plain English
This article is the entry point to the Law, since it shows who is subject to its provisions. The Law is not limited to one military body, but covers all Saudi military enlisted personnel serving in four bodies:
- The Ministry of Defense and Aviation.
- The Ministry of Interior.
- The National Guard.
- General Intelligence.
To understand the word "enlisted person", refer to Article 2, which defines him as any military member whose rank is below officer. Officers therefore do not fall within the scope of this Law as enlisted personnel; it covers those in enlisted ranks. Article 2 also defines "the Minister" as the competent minister or head of the body to which the enlisted person belongs, each with respect to the military body he heads, so the powers the Law gives the Minister are exercised by the head of the body in which the enlisted person serves.
The article requires the enlisted person to be a Saudi and an active military member in one of these bodies. In practice, an enlisted person's rights and duties in appointment, promotion, salaries, leave and end of service derive from this Law as long as he falls within its scope.
If you have a question about how the Law applies to your service position, you can consult a lawyer who specializes in administrative cases and military service matters.
Practical example
Khaled serves as a corporal in the National Guard, and his brother serves as a sergeant in the Ministry of Interior. Each is a Saudi active military enlisted person in one of the bodies the article mentions, so each is subject to the provisions of the Enlisted Personnel Service Law even though the bodies in which they serve differ.
