Article 3 explained in plain English
This article identifies the judicial body that carries out enforcement under the Enforcement Law before the Board of Grievances, at two levels:
- The Administrative Enforcement Court: one or more courts are established as needed by decision of the Administrative Judiciary Council, made up of a president and a sufficient number of judges. It has jurisdiction over two matters: enforcing the instrument, and deciding its enforcement dispute. It works through circuits, each of which is a single judge.
- Enforcement circuits in the administrative courts: in regions and governorates where no administrative enforcement court has been established, one or more enforcement circuits are established as needed within the administrative court, with the same jurisdictions provided for the Court.
The practical meaning is that the holder of the instrument goes to the Administrative Enforcement Court if one exists, and to the enforcement circuit in the administrative court where that court does not exist. Under the definitions in Article 1, the instrument is the enforcement instrument covered by the Law, and an enforcement dispute is a claim relating to the conditions for the validity of enforcement and the soundness of its procedures.
Article 2 complements this provision by obliging the judgment debtor to act promptly to enforce, and then Article 4 comes to set the instruments with which compulsory enforcement is permitted before this court.
If you have a specific case, it is best to consult a lawyer specialized in administrative cases and enforcement cases before the Board of Grievances.
Practical example
Fahad obtained a final judgment from the administrative court against a government body in a governorate where no administrative enforcement court has been established. In this case the enforcement circuit in the administrative court in that governorate, if established, is the competent one for enforcement, with the same jurisdictions as the Administrative Enforcement Court.
