Article 23 explained in plain English
This article specifies the content of a request to suspend the time limits, the request regulated by Article 22. Article 22 allows the Enforcement Circuit, on compelling reasons put forward by the party against whom enforcement is sought, to order the time limits in Articles 10 and 16 suspended for a period or periods not exceeding 6 months in total, or the suspension or its extension to be by agreement of the parties for no more than 12 months.
A suspension request must contain:
- the particulars required under Article 6 of the Law;
- the reasons for the request, that is, the reasons that justify suspending the time limit;
- a statement of the procedures required for enforcement;
- the periods needed for enforcement.
The aim is that the Circuit has a clear picture on which to assess the request: why the suspension is sought, what procedures enforcement requires, and how much time it needs. A suspension request is not a bare request for postponement; the person making it must set out what enforcement actually requires.
It is followed by Article 24, which allows the enforcement requester to declare before the Enforcement Circuit that he is abandoning his request at any stage. The abandonment ends the request and the procedures taken on its basis, without preventing the filing of a new request.
