Article 18 explained in plain English
1. Land only: the value of the part taken is assessed if the remainder is usable under the technical instructions applied in the area; if it is not usable, the value of the whole land is assessed.
2. Land, buildings and plantings:
- The remainder of the land is usable and the buildings and plantings are not affected: only the value of the part of the land taken is assessed.
- The remainder of the land, buildings and plantings is usable: the value of the part of the land taken and of what is affected of the buildings and plantings on it is assessed, and the costs of repairing and restoring the remaining part of the building are added if they equal or are less than the value of that part.
- The remainder of the land is usable but the remainder of the buildings or plantings is not: the value of the part of the land taken is assessed, together with the value of the whole building or plantings.
- The remainder of the land is not usable: the value of the whole property, land, buildings and plantings, is assessed.
Who decides whether it is usable? A committee of the Municipality (Amanah) or competent municipality and the project owner, together with one or more representatives of the Ministry of Agriculture if the land is agricultural, which refers its report to the body for referral to the assessment committee.
3. Demolition: the project owner bears the costs of demolishing and removing the remaining part of the building if it is not usable.
4. Benefiting from the remainder: the owner may ask to benefit from the remaining part if it adjoins another property he owns under a separate title deed.
In practical terms, the owner is not left with remnants of a property that cannot be used. Anyone from whose property part has been taken can consult a lawyer specializing in real estate cases.
Practical example
Part of Faisal's house in Abha was expropriated to widen a street, and the committee decided that the remainder of the building is not fit for residence while the land remains usable. Compensation is paid for the part of the land taken and for the value of the whole building, and the project owner bears the costs of demolishing the remaining part.
