Article 13 explained in plain English
This article sets an annual duty of disclosure, which complements the disclosure tied to each campaign. When preparing its annual budget, the licensed entity must state:
- The proceeds of donation collection.
- Its items of revenue, meaning the revenue items in detail.
- Its expenses.
This must be supported by documents, so it is not enough to state figures without what proves them.
The aim of this duty is that the entity's financial picture over the year is clear and verifiable, and that it shows what it collected in donations and how it spent it. Under Article 1, the licensed entity means associations, civil foundations and other non-profit sector bodies that hold a license to collect donations.
This article comes after Article 12, which requires spending from donations to be by joint signature of at least two persons, with the financial officer's signature essential, and from the approved bank accounts; the documents resulting from this spending are what support the budget. Article 14 follows, requiring the licensing authority to suspend a licensed entity from collecting donations for the purpose for which it collected them if it violates any provision of the Law when collecting donations.
This article does not specify the form of the budget or the body to which it is submitted.
