Article 7 explained in plain English
After Article 6 required a cosmetic product to be listed before it is imported or circulated, this article sets out who has the right to submit the listing application, which is one of three:
- The manufacturer that produces the cosmetic product.
- The producing company of the product.
- Whoever the manufacturer or producing company authorizes, such as an agent, a distributor or another party to whom either of them gives authorization to do so.
This means a person who is neither a manufacturer nor a producing company, such as a trader who buys the product to sell it, may submit a listing application only if authorized by one of them. The detailed procedures and conditions for submitting the application are set by the Implementing Regulations, and the text does not state them.
Article 8 follows, requiring the Authority to decide on the listing application within 15 days of its requirements being completed. The person in whose name the product is listed becomes the lister as defined in Article 1, and bears the responsibilities the law sets.
Anyone who wants to arrange an authorization relationship with a foreign company can consult a lawyer specializing in commercial law and food and drug law.
Practical example
A company in Riyadh is the exclusive distributor of a French perfume brand. To apply to list the perfumes with the Authority, it needs an authorization from the French producing company, because the article limits submitting the application to the manufacturer, the producing company, or whoever they authorize.
