Article 1 explained in plain English
This is the definitions article. It fixes the meaning of the terms used throughout the law unless the context requires another meaning. The most important are:
- The Ministry and the Minister: the Ministry of Municipal, Rural Affairs and Housing, and its minister.
- The Regulations: the Implementing Regulations of this law, to which the law refers many details.
- Classification: assessing a contractor's financial, technical, administrative and executive capabilities in order to place him in the field, activity and grade he deserves in accordance with the law and the Regulations.
- Contractor: a natural person (an individual) or legal person (such as a company) lawfully licensed to perform, alone or jointly with others, a contract in one of the fields specified by the Regulations.
- Field: the type of work in which the contractor is classified, and activity: a type of sub-work within a field.
- Grade: the result the contractor obtains on classification.
- Criterion: the set of elements used in classification.
Understanding these definitions is necessary for reading the other articles; for example, Article 2 makes classification and issuing its certificates among the Ministry's tasks. Note that the definition of contractor requires that he be lawfully licensed, and that the fields themselves are left to the Regulations, so the law does not name them.
