Article 3 explained in plain English
This article distributes roles in the sector: the Ministry is the body for supervision and policy-making, within the limits of the Law and related laws, and without conflict with the powers of other bodies.
The Ministry's most prominent tasks:
- Setting the sector's strategies, policies, plans, programs and infrastructure and supervising their implementation.
- Proposing draft laws and regulations in coordination with the Authority, and supervising their implementation once approved.
- Representing the Kingdom regionally and internationally in the sector's affairs, and it may grant the power of representation to the Authority or another related body.
- Encouraging investment and research, and contributing to the localization of jobs and the qualification of human resources.
- Issuing policies on emerging technologies and the internet, setting digital economy policies, and promoting the standards of digital transformation and digital government.
- Conducting a comprehensive periodic review of the sector's performance, and it may publish its results to the public.
- Taking arrangements, in coordination with the Authority, to ensure the continuation of essential services if a service provider is unable to provide them, as the regulations determine.
- Ensuring the availability of universal service and the universal right of use.
The article provides that its provisions may be amended by a decision of the Council of Ministers, that is, without the need to amend the Law in the usual way. These tasks are linked to the Law's objectives in Article 2 and to the fee the Ministry sets under Article 4.
Practical example
A small communications company serving a village suddenly stopped providing telephone service. Here the Ministry, in coordination with the Authority, takes the arrangements needed to ensure the continuation of essential services for the village residents, as the rules in the regulations determine.
