Article 35 explained in plain English
This article sets the date on which entitlement to the pension begins, which matters for knowing from which day dues are calculated.
- The retiree: entitlement to the pension begins on the day after the date the service ends.
- The beneficiaries of the retiree: entitlement begins on the day after the retiree's death.
The retiree means the employee whose service has ended, and the beneficiary means the person who has been granted a pension because of their relationship to the pensioner, as defined in Article 1.
It is important to distinguish between the start of entitlement and the start of actual payment: this article fixes the day on which the right arises, and does not deal with how long the procedures take before the pension is actually paid. If payment is delayed, entitlement is still counted from the date set in the article.
This article follows Article 34, which explains how the age of the retiree or beneficiary is determined, and precedes Article 36, which provides that where a person dies after the Law takes effect and had become entitled to a pension before it took effect, the beneficiaries are treated under the provisions of this Law.
Practical example
Khaled's service ended on the 30th of a given month, so his entitlement to the pension begins on the very next day. If he later dies, the entitlement of his family beneficiaries begins on the day after his death.
