Article 18 explained in plain English
This is one of the most important Articles of the Law, because it determines when an employee is entitled to a pension at the end of his service. The cases under paragraph 1 are:
- At least 25 years: if his service counted for retirement reaches 25 years, or his civil and military service counted together reaches 25 years.
- 20 years at the employee's request: he may request retirement and obtain the pension after a counted period of service of not less than 20 years, provided the competent authority that holds the power to appoint someone of his rank approves.
- 15 years in special cases: if the service ends because the post is abolished, or because of dismissal by decision of the Council of Ministers or by royal order, unless the decision or order states that the dismissal is for a disciplinary reason.
- Whatever the length: if the service ends because of death, or because of "a disability and reaching retirement age" as the text puts it.
Paragraph 2 – civil and military service that does not reach the pension period: A gratuity is settled for the civil service under the Civil Retirement Law, and a gratuity for the military service under the military retirement law in force at the time his last service ended, and the total of the two gratuities is paid from the Civil Retirement Fund.
The current wording was amended by Royal Decree No. M/48 dated 12/8/1403 AH. This Article follows Article 17 on counting secondment and study leave, and precedes Article 19, which sets out how the pension is settled. Because the cases are many and depend on the reason service ends, anyone planning retirement should consult a lawyer who specializes in retirement and administrative matters.
Practical example
Mohammed is a civil employee with 21 years counted for retirement, and he wishes to retire early. He may request retirement and obtain the pension because his service exceeds 20 years, but this is conditional on the approval of the authority that holds the power to appoint someone of his rank.
