Article 22 explained in plain English
This Article sets a special rule for the pension of a minister who is a member of the Council of Ministers when his service ends: his pension is settled by one of two methods, whichever is better for him:
The first method:
- A pension of 25% of his salary in the ministerial post is fixed for him, however long his service in that post and however often he held it.
- To it is added a pension for his service in posts other than the ministerial post counted for retirement, calculated at one-fortieth of the average monthly salary in the last two years of that period.
The second method: His pension is settled for the total of his services counted for retirement, including his service in the ministerial post, in accordance with Articles 19, 20 or 21.
The maximum: The Article provides that a minister's pension may in no case exceed four-fifths of his salary in the ministerial post.
Among the Articles to which the second method refers is Article 21, which settles the pension of someone who dies or is dismissed for total disability arising from work at four-fifths of the last monthly salary. After this Article comes Article 23, which regulates the gratuity for someone whose service did not reach the pension period.
