Article 30 explained in plain English
This is the general penalties article in the Civil Defense Law, and consists of two paragraphs:
Paragraph (a): the general penalty
Anyone who violates any provision of the Law, or its regulations, or the decisions issued under it, is punished by one of the following penalties or both together:
- Imprisonment for a period not exceeding six months.
- A fine not exceeding SAR 30,000.
The paragraph begins with the phrase "subject to Articles 27, 28 and 29", meaning that this general penalty does not affect the special provisions in those articles:
- Article 27: non-military civil defense personnel in war, emergencies and disasters are subject to the military service rules as to penalties, detection and investigation.
- Article 28: removing or disabling civil defense machines and signals without coordination, punishable by a fine not exceeding SAR 50,000 plus restoration costs.
- Article 29: violating the civil defense plan in emergencies and disasters, punishable by what the Minister of the Interior sets, not exceeding imprisonment for a year and a fine of SAR 50,000, or either of them.
Paragraph (b): committees to hear violations
- The Minister of the Interior, Chairman of the Civil Defense Council, forms committees, each of at least three members, one of whom has Sharia or legal qualifications.
- The committee hears violations of the Law and imposes the penalty of a fine.
- If the committee considers that the violation calls for imprisonment, it is referred to the Board of Grievances.
So the committee has no power to order imprisonment; its competence is limited to the fine. Article 31 allows an appeal against the penalty decision before the Board of Grievances within 60 days of notification of the decision. The text of this article was issued by Royal Decree No. (M/66) dated 2/10/1424 AH.
Anyone against whom a violation has been issued can consult a lawyer specializing in administrative matters.
Practical example
A shop in Riyadh is found violating safety requirements issued under the civil defense regulations. The violations committee formed by decision of the Minister of the Interior hears the violation, and may impose a fine not exceeding SAR 30,000; if it considers that the violation calls for imprisonment it refers it to the Board of Grievances. The shop owner may appeal the penalty decision within 60 days of being notified.
