Article 100 explained in plain English
This article gives the General Authority of Civil Aviation two oversight tools over operators.
1- The right of entry and inspection: The Authority's approved representatives have the power to enter at any time any workplace belonging to the operator, to inspect and monitor the implementation of:
- the operations specifications;
- the laws and instructions in force in the Kingdom.
2- The right to stop: The Authority has the right to stop any flight or air route if it considers that its level of operation violates the operations specifications or the laws and instructions in force.
Procedural safeguard: This is done under clear procedures set by the Regulations, so the text ties the power to stop to procedures set in advance, though it does not give their details.
Practical effect: The operator may not prevent the Authority's approved inspectors from entering its offices, hangars or other workplaces. Its operation must conform to the specifications and laws at all times, because a violation may lead to the stopping of a particular flight or of an entire air route.
This article follows Article 99, which requires the operator of a Saudi aircraft to observe the Law's provisions wherever it is, and precedes Article 101, which makes the operator or its representative responsible for monitoring the flight operations of its aircraft. Anyone subject to a stop who wants to challenge it is advised to consult a lawyer specializing in administrative cases and civil aviation law.
Practical example
Authority inspectors visit the operations center of an airline in Jeddah without prior notice and find that the operation of one of its routes does not conform to the approved operations specifications. The inspectors have the right to enter and inspect, and the Authority has the right to stop that route under the procedures set by the Regulations.
