Article 4 explained in plain English
This article sets out when membership ends in the Association, in five cases:
- Death.
- Removal from the roll of licensed lawyers; this case concerns core members, because their membership rests on the license.
- Delay in paying the fee: if the member is late in paying the membership fee due for a period exceeding 90 days from its due date, and 15 days have passed from the date of being warned to pay. Both conditions apply together; membership does not end through delay alone without a warning.
- A reasoned decision of the board of directors ending membership; giving reasons is a condition of the decision.
- Withdrawal from membership of the Association.
The practical effect of core membership ending is that the lawyer loses what is tied to it in the Statute, including membership of the general assembly, because Article 5 makes it consist of all core members. Note that the article's cases vary: some are by the member's will, such as withdrawal; some due to a cause outside their control, such as death; and some by decision, such as removal or the board's reasoned decision.
The article does not set out procedures for objecting to a decision ending membership, and anyone against whom a decision is issued and who wishes to object should consult a lawyer who specializes in administrative cases.
Practical example
Sarah, a lawyer, was 100 days late in paying her annual membership fee from its due date, but the Association did not send her a warning to pay. Her membership does not end for this reason until 15 days have passed since her warning.
