Article 15 explained in plain English
This article moves from punishing offenders to protecting the victim, and requires certain measures to be taken regarding them at the investigation or trial stage:
- Informing them of their legal rights in a language they understand.
- Giving them the opportunity to explain their situation, including that they are a victim of human trafficking, and their legal, physical, psychological and social situation.
- Referring them to the competent doctor if it appears that they need medical or psychological care, or if they request it.
- Placing them in one of the medical, psychological or social rehabilitation centers if it appears that their medical, psychological or age-related condition calls for it.
- Placing them in one of the specialized centers if they need shelter.
- Providing them with security protection if the matter requires it.
- If they are a foreigner and there is a need for them to stay in the Kingdom or to work during the investigation or trial proceedings, the Public Prosecution or the competent court assesses this.
Note that some of these measures are subject to a condition: referral to a doctor is where there is a need or at the victim's request, placement in centers is where there is a need, security protection is if the matter requires it, and a foreigner's stay or work is left to the assessment of the Public Prosecution or the court. Informing them of their rights and giving them the opportunity to explain their situation appear without any condition.
It is followed by Article 16, which makes investigation and prosecution of the Law's crimes the jurisdiction of the Bureau of Investigation and Public Prosecution, including inspecting the places where victims are sheltered. Anyone who is a victim or is helping a victim would do well to consult a lawyer specializing in criminal cases.
Practical example
A foreign worker was rescued from a house where she was being forced to work. During the investigation she is told of her rights in her own language, referred to a doctor because she suffers psychological effects, and placed in a specialized center because she has no shelter. If she needs to stay in the Kingdom until the case ends, the Public Prosecution or the court assesses this.
