Article 11 explained in plain English
This article encourages members of the public to contribute to combating commercial fraud through a financial reward. Its provisions:
- Who is entitled: anyone who helps in uncovering cases of commercial fraud other than the employees referred to in Article 5, that is, other than the employees of the Ministry, the Ministry of Municipal and Rural Affairs and the Food and Drug Authority appointed to detect violations.
- Condition of entitlement: the help must lead to catching and convicting the violators; merely submitting a report is not enough if it does not end in that.
- The amount: a percentage not exceeding 25% of the amount of the fine collected, that is, the fine actually collected, not just the fine imposed.
- Details: the Implementing Regulations specify them.
The percentage stated is a ceiling, so the reward may be less than it, as the Regulations specify. The enforcement employees themselves have separate rewards governed by Article 10 under rules issued by the Council of Ministers.
This means that a consumer, worker or anyone who discovers a case of fraud and helps uncover it may be entitled to a share of the fine, once the case ends with the violator being caught and convicted and the fine collected.
Practical example
Khaled noticed that a bakery in his neighborhood uses scales that show less than the true weight, so he reported it to the competent authority and provided information that helped uncover it. The bakery was caught and convicted and the fine was collected, so Khaled is entitled to a reward of no more than 25% of the fine collected, as the Regulations specify.
