Article 3 explained in plain English
Article 3 regulates the fees for advertising and publicity boards, and sets maximum limits for them, not fixed amounts:
- An amount not exceeding SAR 600 a year for each square meter or part of one, for the boards in paragraphs (1, 3, 4, 5, 8, 9, 10, 11) of Article 1. These boards include, according to Article 1: boards on sidewalks, lighting poles and squares inside cities, boards on private property, boards on buses inside cities, and boards on roads outside the built-up area.
- An amount not exceeding SAR 400 a year for each square meter or part of one, for the boards in paragraph (2), which are the illuminated and ordinary signage boards for commercial shops.
- Criteria for fixing the fee: the competent minister or his equivalent sets the criteria for determining the amount of each fee according to the type of board, its location, the technology used, the license period and so on, and he may make the basis for calculating the fee daily, weekly, monthly or annual, provided it does not exceed the annual maximum, in agreement with the Non-Oil Revenue Development Center.
Note that the calculation is for each square meter or part of one, so a board with an area of one and a half meters is counted as two meters. The article does not state the actual amount but the upper limit, and leaves the detail to the competent minister's criteria.
This article was amended by Council of Ministers Resolution No. (486) dated 5/11/1437 AH, then by Council of Ministers Resolution No. (31) dated 11/1/1444 AH to its current text. A person who has a dispute over the amount of a board's fee may consult a lawyer specializing in administrative cases and government contracts.
Practical example
Abdullah owns a clothing shop in Dammam and his signage board has an area of three and a half square meters. The fees are calculated for 4 meters because a part of a meter is treated as a meter, at a maximum of SAR 400 a year per meter, so the annual fee does not exceed SAR 1,600, and the actual amount is set according to the criteria of the competent minister.
