Article 18 explained in plain English
This article states when a license to carry or acquire a weapon is cancelled, in four cases:
- (a) Confiscation: if confiscation of the weapon and its ammunition is decided.
- (b) Loss of a condition: if the licensee loses one of the conditions for granting the license.
- (c) Death or loss of capacity: if the licensee dies or loses his legal capacity.
- (d) Final departure of a resident: if it is decided that the licensed resident will leave the Kingdom permanently.
Disposal of the weapon after cancellation: if the cancellation is under paragraph (b), (c), or (d), the weapon and its ammunition are disposed of by the owner of the weapon, the heirs of the deceased, their legal agent, or the guardian of minors, in light of what the Implementing Regulations determine. This rule does not cover the case of confiscation in paragraph (a).
The article does not specify the method or procedures of disposal; it refers them to the Regulations.
This article is linked to Article 17, which provides that all licenses issued under the Law benefit only the licensee himself. That is why a license to carry or acquire is cancelled on the death of its holder under paragraph (c), and the heirs dispose of the weapon in accordance with the Regulations. Article 19 deals with cancelling a license to import personal firearms or licenses to sell, buy, or repair them, in the cases of death or loss of capacity and loss of a condition for granting the license.
Anyone whose license has been cancelled, or to whom a weapon has passed whose owner's license was cancelled, may consult a lawyer who specializes in administrative matters and weapons regulations.
Practical example
A resident in Al-Khobar holds a license to acquire a pistol, and it is decided that he will leave the Kingdom permanently when his work ends. Under paragraph (d), his license is cancelled, and he disposes of the pistol and its ammunition in light of what the Implementing Regulations determine.
