Article 13 explained in plain English
This article regulates marine vessel waste, which under Article 1 is waste produced by all means of transport and floating units used for maritime activities, including ships, fishing boats, pleasure boats and marine sports craft. The obligations are distributed among four parties:
1- The operator or owner of the marine vessel: he must deliver the waste produced by the vessel or by its operation, and all the waste covered by the international agreements to which the Kingdom is a party, to the waste reception facilities operating in the ports, or in accordance with the mechanism set by the competent authorities.
2- The General Authority for Ports: it must provide the mechanism needed for the facilities receiving port and marine vessel waste, or send it to other facilities licensed by the Center for disposal, as set by the Implementing Regulations.
3- All ports: they must contract with service providers licensed by the Center to transport and treat the waste received in them or produced by their operations.
4- Supplying the Center with records: the Center must be supplied periodically with a copy of the records and documents of marine vessel waste reception, including the volume and types of waste, the mechanisms for treating it and its locations. The text does not name the party charged with this supply.
The article also covers small boats, since a pleasure or fishing boat falls within the definition of marine vessels.
Article 12 obliges residential and commercial complexes and government administrative bodies to contract with a licensed service provider, and Article 14 imposes extended producer responsibility on the producer and importer.
If you have a practical case relating to this provision, it is best to consult a lawyer who specializes in environmental and administrative laws.
Practical example
A fisherman returns with his boat to the fishing port in Qatif carrying used engine oil and the remains of damaged nets. Under this article, he must deliver this waste to the waste reception facilities operating in the port, or in accordance with the mechanism set by the competent authorities, instead of throwing it into the sea.
