Article 12 explained in plain English
This article protects the volunteer from serious harm that may befall him because of his voluntary work, and distinguishes two cases:
First case (paragraph 1): a disability or impairment that definitively prevents him from working, or death. In it the volunteer, or his heirs in case of death, is given compensation under the labor law applied at the beneficiary body. The article does not set the amount of compensation itself, but refers its assessment to the labor law applied at that body.
Second case (paragraph 2): partial disability or permanent impairment that does not prevent him from doing his work. In it he is paid compensation assessed on the basis of the percentage of disability he suffered, calculated from the compensation referred to in paragraph (1). The percentage of disability is determined by the competent medical body.
The shared condition in both cases is that the disability or death be caused by the voluntary work; it is not enough for the injury to occur during the volunteering period if its cause was not the voluntary work.
The article complements the volunteer's right under Article 10 to treatment if he is injured during training or voluntary work or on the way to and from it; treatment is a right that exists on injury, whereas compensation is tied to disability or death as set out. Anyone injured while volunteering who wants to know what he is entitled to can consult a lawyer specializing in civil and compensation cases.
Practical example
Saad was injured while taking part as a volunteer in rescue work organized by a beneficiary body, and the competent medical body decided that he has a partial disability that does not prevent him from doing his work. He is paid compensation assessed by the percentage of disability, calculated on the basis of the compensation set for total disability under the labor law applied at the beneficiary body.
