Article 23 explained in plain English
This article regulates members' access to the Commission's documents, and contains two provisions:
- Place of access: a member of the Commission views the agenda and its attachments at the Commission's meeting place.
- Ban on taking them out: the member may not take the Commission's documents outside the meeting place.
The aim of this provision is to protect the confidentiality of the Commission's documents: the member can view everything needed to take part in the meeting, but without the documents leaving the designated place. A balance is thus kept between the member's right to know and the duty of confidentiality.
This article is linked to Article 22, which requires voting on the Commission's decisions to be by secret ballot according to a form prepared for this purpose; both protect the confidentiality of the Commission's work, the first the secrecy of the votes and the second the secrecy of the documents. It is also linked to Article 24, which provides that the King appoints a Secretary General for the Commission who completes the procedures for calling its meetings, supervises the preparation of its minutes and decisions and announces the statements of its meetings as the chairman of the Commission decides.
