Article 11 explained in plain English
This article identifies the body that examines violations and decides the penalty, which is "the Committee" that Article 1 defined as the committee for examining violations of the Law. Its provisions:
- Formation: by decision of the Minister of Interior.
- Number and spread: one or more committees in each region.
- Membership: three members, one of whom holds a Sharia or legal qualification.
- Jurisdiction: examining the violations set out in the Law and deciding the appropriate penalty under Article 12.
Article 12 sets the penalties, which are fines on the natural person or private legal person subject to the Law, including: SAR 500 for each camera or device that violates the technical specifications in the conditions document, SAR 1,000 for each camera or device not installed under the conditions document, SAR 1,000 for each violation of paragraph 2 of Article 6, SAR 5,000 for not keeping recordings under paragraph 2 of Article 4, SAR 10,000 for each violation of paragraph 1 of Article 6, and SAR 20,000 for transferring or publishing recordings in violation of the Law or destroying or sabotaging the devices or recordings. The committee chooses the appropriate penalty within what that article provides.
The committee comes after the detection stage regulated by Articles 9 and 10; under Article 10, detecting some violations, other than those of a security nature, may be assigned to the private sector.
If a violation by your facility has been referred to the committee, you may consult a lawyer specialized in administrative matters.
Practical example
A violation was detected at a hotel in Makkah concerning the failure to put up signs showing that cameras are in use. A committee formed by decision of the Minister in the region, of three members, examines the violation and decides the appropriate penalty under Article 12.
