Article 23 explained in plain English
This is the penalties article of the Law, and it rests on several rules:
1. Contractual penalties remain: the penalties do not prejudice the Ministry of Transport's right to impose the sanctions and penalties stated in the concession contract or the transport license.
2. The main penalty: anyone who violates the provisions of the Law or the regulations governing it is punished with the penalty set for the violation attributed to them under the Traffic Law. The provisions of the Traffic Law are not part of this text, so those penalties cannot be determined from this article.
3. The fallback penalty: if the Traffic Law sets no penalty for the violation, the violator is punished with a fine of not less than SAR 500 and not more than SAR 5,000 for each occasion.
4. Barring and suspension: the Minister of Transport may, in all cases:
- bar the truck, its driver or its owner from working in carrying goods and equipment, or
- suspend the licenses issued to them,
for a period not exceeding one year.
5. Procedures: the procedures and rules stated in the Traffic Law apply to investigation and trial.
6. Compensation: the penalties and sanctions do not prevent claiming from the person concerned compensation for damage to persons and property under the regulations issued in this respect.
These penalties apply to violating provisions such as the ban on unloading goods on roads (Article 17) and violating transit transport routes (Article 16). Anyone accused of a violation may consult a lawyer who specializes in administrative cases and transport regulations or a lawyer who specializes in criminal cases.
Practical example
A truck owner in Riyadh unloaded his cargo on a public sidewalk in violation of Article 17. He is punished with the penalty set for this violation in the Traffic Law if there is one, and otherwise with a fine between SAR 500 and SAR 5,000. The Minister of Transport may also bar him or his truck from working in carrying goods or suspend his license for a period not exceeding one year, and anyone harmed by the cargo may claim compensation.
