Article 2 explained in plain English
This article sets out the aim of the Product Safety Law, which is protecting the consumer, through two means:
- Preventing the hazard associated with products that are placed or made available on the Kingdom's markets.
- Setting out how to deal with the hazard and risks associated with those products.
To understand the article, refer to the definitions in Article 1: the consumer is a natural or legal person who uses a product, so protection is not limited to individuals but includes companies and bodies that use products. Hazard is any property, act or omission that constitutes or may constitute a danger to the safety of the consumer, property or the environment. Risks are the combination of the probability of the hazard occurring and its severity, even if its effects are not apparent or immediate.
The Law thus does not confine itself to dealing with harm after it occurs, but seeks to prevent it in the first place, and sets out an approach for dealing with the risks that may appear in products in circulation.
Article 3 follows, setting the scope of application of the Law to all products, including those circulated by electronic means, except products whose competence is assigned to the Food and Drug Authority.
