Article 1 explained in plain English
This is the definitions article, through which the Law's other provisions are understood. Its most important points are:
- The Authority: the Saudi Food and Drug Authority; the President: its Chief Executive Officer; and the Board: its Board of Directors.
- Pharmacist: a holder of a bachelor's degree in pharmaceutical sciences or a Doctor of Pharmacy degree from a pharmacy college in the Kingdom, or an equivalent. Pharmacy technician: a holder of a pharmacy technician certificate from a health institute or college in the Kingdom, or an equivalent.
- Pharmaceutical product (medicine): a product in pharmaceutical form containing one or more substances used externally or internally to treat or prevent disease in humans. Herbal product: a plant or herb that has a medical claim and is prepared in pharmaceutical form.
- Adulterated: a product whose content, identity or source has been deliberately altered with intent to deceive, even if it contains the same ingredients. It is also considered adulterated if it is contaminated, or its ingredients are contaminated, wrong, ineffective or of insufficient effectiveness, or it has no active ingredients, or it is in counterfeit packaging. Spoiled means a product whose properties have changed so that it is unfit for use.
- Pharmaceutical establishment: the factory, trading warehouse, scientific office, or drug consultation or analysis center.
- Pharmacy is separately defined as the establishment prepared for preparing and dispensing or selling products, and an herbal products sales establishment is one prepared for preparing and selling herbal products.
Note that the pharmacy and the herbal sales establishment are not included in the definition of "pharmaceutical establishment", a distinction that affects the understanding of the articles that use this term, such as Article 2.
