Article 7 explained in plain English
This article regulates how the penalties stated in Article 6 are imposed, and the safeguards connected with them:
- Violation committees: the Minister of Interior, Chairman of the Civil Defense Council, or his delegate, forms a committee or committees to hear violations and impose the penalties stated in Article 6. The committee must consist of at least three members, one of them from the relevant authority and another with Sharia or legal qualifications.
- Approval of the penalty: penalties are not enforceable until approved by the Minister of Interior or his delegate.
- Notification and grievance: the decision imposing the penalty is notified to the person against whom it is issued, and states his right to file a grievance before the Board of Grievances in accordance with its law.
- Referral for investigation: if the violation constitutes a serious fault or results in serious harm, the committee refers the case papers, by decision of the Minister of Interior, to the Bureau of Investigation and Public Prosecution.
The penalties the committees consider, as stated in Article 6, are a fine not exceeding thirty thousand riyals with closure of the premises until the violation is removed for violating the Law, and a fine not exceeding five thousand riyals for violating the Regulations, with the violator obliged to remove the harm, repair it or compensate for it. As for confiscation of the contents of the premises on repeat offending, Article 6 provided that it is by court judgment.
The article does not specify the period or procedures for the grievance, but refers to the law of the Board of Grievances. A person against whom a penalty decision was issued and who wants to file a grievance against it would do best to consult a lawyer specializing in administrative cases.
