Article 1 explained in plain English
Article 1 sets out the meanings by which the terms of the Regulations are understood, unless the context requires otherwise. The most important definitions are:
- Municipal violation: failure to comply with the provisions of the Regulations, with its implementing decisions, or with the requirements, rules, controls, and instructions whose implementation the Amanah or the municipality is competent to supervise as established by law.
- Serious municipal violation: a municipal violation that is likely to cause serious harm to human health or safety or to public health.
- Violator: whoever commits a violation, whether an individual or a legal person such as a company.
- Municipal license: a written approval issued by the Amanah or the municipality under the Municipal Licensing Procedures Law, to build an establishment, open a shop for any activity at a given location, or begin operating in an establishment.
- Shop: a location holding a municipal license where an activity related to the competences of the Amanah or the municipality is carried out, other than an establishment.
- Establishment: an entity holding a municipal license that carries out production, packaging, or processing activities.
- Regulation lines: lines in the approved plan that show the boundaries of a property and separate it from neighboring properties and public property.
The distinction between an ordinary violation and a serious one is fundamental, because Article 2 raises the maximum fine for a serious violation to one million riyals instead of five hundred thousand, and limits cancellation of the license and the ban on carrying on the activity for up to two years to serious violations. Anyone whose violation has been classified as serious and who disagrees may consult a specialized lawyer in administrative matters (the Board of Grievances).
